1. Decree 57/2021/ND-CP on tax incentives for enterprises manufacturing supporting industrial products
Decree 57/2021/ND-CP provides corporate income tax (CIT) incentives for projects manufacturing supporting industrial products. The purpose is to encourage businesses to invest in this field, contributing to economic development.
Enterprises are eligible for incentives if they meet the following conditions:
1. Having a new or expanded investment project
2. Producing products in the list of priority supporting industries
3. Implementing the project before 1/1/2015
4. Meeting the requirements under Law 71/2014/QH13
5. Being granted a certificate of incentives from a competent authority
The Decree stipulates 4 cases where enterprises are entitled to incentives:
1. Never enjoyed corporate income tax incentives: enjoy incentives from the tax period for which the certificate is issued
2. The incentive period under other conditions has expired: enjoy incentives for the remaining period
3. Currently enjoying incentives under other conditions: can switch to enjoying new incentives for the remaining period
4. Has exhausted all incentives under other conditions: enjoy new incentives for the remaining period
The remaining preferential period is calculated by taking the total preferential period under the new regulations minus the preferential period under the old conditions (if any). Specifically:
- Remaining tax exemption period = New tax exemption period - Enjoyed tax exemption period
- Remaining tax reduction period = New tax reduction period - Enjoyed tax reduction period
- Remaining preferential tax rate application period = New preferential tax rate period - Enjoyed preferential tax rate period
If the application of the new regulations leads to a decrease in the amount of declared or collected corporate income tax or late payment fees, the enterprise can submit a written request for adjustment to the direct tax authority. If after the adjustment there is an excess payment, the enterprise will be handled according to the provisions of Article 60 of the Law on Tax Administration.
Applying this tax incentive will help enterprises reduce costs and increase competitiveness in the market. Enterprises should carefully study the regulations to maximize the benefits of this policy. They can consult experts to understand how to apply it to their specific cases.
